Understanding the Changes
New tariffs are always a challenge, and President Trump’s recent executive orders concerning tariffs on goods from Mexico, Canada, and China are no exception. Here’s a quick overview to keep you in the loop.
Canada and Mexico Tariffs
Although President Trump signed an order on February 2, 2025, adding a 25% tariff on goods from Mexico and Canada, the US government has paused implementation of the new tariffs for 30 days. Tariffs on almost all imported goods from the two countries were scheduled to take effect on February 4, 2025.
China and Hong Kong Tariffs
President Trump also signed an executive order placing additional tariffs on goods from China and Hong Kong. The impact of the order:
- Effective February 4, 2025, a 10% additional ad valorem duty applies broadly to Chinese and Hong Kong goods, which is in addition to any applicable Section 301 tariffs, with specific exemptions. The new tariff code is 9903.01.20
- Exclusions Include humanitarian donations (HS 9903.01.21) and informational materials (HS 9903.01.22), along with goods in transit before February 1, 2025 (HS 9903.01.23).
- Chinese goods will lose the de minimis administrative exemption available under 19 U.S.C. § 1321(a)(2)(C). Formal entry and applicable duties are now required (see details about this exemption here).
